The Environmental Protection Agency (EPA) is revisiting the standards it uses in identifying businesses that qualify as small manufacturers (including importers) and processors that are generally exempt from reporting and recordkeeping rules under the Toxic Substance Control Act (TSCA) Section 8(a). Reporting requirements under TSCA Section 8(a) include the Chemical Data Reporting (CDR) rule. This action is being taken as the agency continues to implement the Frank R. Lautenberg Chemical Safety for the 21st Century Act, which amended TSCA.

Current standards are based in total annual sales (combined with those of any parent company) and annual production or importation volume of a substance, with sales adjusted if needed using the Producer Price Index for Chemicals and Allied Products, as compiled by the Bureau of Labor Statistics (BLS). The notice was published December 15 and includes details on the standards. Comments to assist EPA in determining whether revision of the standards is warranted are due January 17.
